The Open

A majority of the OKXICE roster has said no: Walmart, Eli Lilly, Cigna, Carnival and Arcos Dorados objected in a notice dated Oct 28, taking the count to 38 of 62 companies, 61%. The same day, the venue's parent ICE bought into Trade.xyz to build a 24/7 US perpetuals market on Hyperliquid, stocks included. Nasdaq, meanwhile, was reported to be phoning its listed companies to advise them to object.

THE 3AM LINE: rwa.xyz printed $3.77B, up about $30M on the day; xStocks added $11.6M; Polymarket did not trade for a sixth day.

Top of the Tape

One day: the boards voted with silence, the parent bought a perps shop, and the oracle learned to work weekends. Same shares, more rails, fewer takers.

Chart of the Day

"The majority line." Yesterday's opt-out curve, redrawn with the crossing: one line of cumulative objectors, a dashed line at 31 (half of 62) and a dashed ceiling at 62. The last two points, 33 and 38, sit above the half line; five names in one notice.

Data points: Oct 15, 9; Oct 19, 16; Oct 23, 22; Oct 26, 26; Oct 27, 33; Oct 28, 38. Roster: 62 companies, OKXICE notice of Oct 4. Sources: Decrypt for the timeline, CoinDesk for "38 of the original 62". Caveat: dates mix notice dates and report dates as Decrypt gives them; Decrypt counts the roster at 62 companies, the Oct 4 notice listed 63 stocks.

Flow Watch

The Rulebook

US. No rule changed. The SEC's TSV list still shows three venues, last updated Oct 21, and says inclusion proves nothing (SEC). Staff FAQs of Oct 20 let a venue name a stock while its 30-day window is open; once it lapses, the venue amends the notice and can trade (Morgan Lewis, Oct 22). Nasdaq's reported calls are persuasion, not rule. For a holder: your offshore token is unchanged; the objector list only narrows which US venue could trade the authorized share.

EU. No change. ESMA's DLT28 proposal (Oct 23) and its call for evidence on tokenised collateral stand as reported (ESMA).

Other. CFTC: the ICE–Trade.xyz venue is "subject to CFTC approval", no filing announced; CME's suit over whether perpetuals are futures or swaps is pending (CoinDesk, Oct 29). For a holder: nothing changes today; a stock perp is a hedge rail, not a share.

Deal Flow

The Playbook (Pro)

Build the silent list. Twenty-four roster names have not objected; Nvidia, Tesla, Apple and Amazon are among them. The first notice went out Oct 4, so 30-day windows start lapsing in early November, issuer by issuer. Silence lets a US venue list the authorized share, and silence cannot be taken back. For each silent name you hold offshore, tag the structure, tracker (Ondo GM) or backed claim (xStocks, bStocks, Dinari, Coinbase), and log its weekday premium to the NYSE close. If OKXICE lists, that premium gets a regulated on-chain reference, and the basis becomes a tradeable number. The tell is the notice amendment saying a window has lapsed.

RISK LINE: windows run from each issuer's receipt of notice, not the public one; OKXICE has no launch date; offshore tokens carry no shareholder rights whatever the venue does; one Nasdaq call can turn a silent name into an objector.

Odds

Polymarket, "First to list tokenized stocks in the US?": Robinhood 37%, no listing by Dec 31, 2027 36.3%, Coinbase 12.5%, Kraken 5.9%, Gemini 4%; volume $90,248, unchanged since Oct 24. Coinbase ladder ($8,169): Oct 31 3%, Dec 31 20%, Mar 31 31%, Jun 30 55%, unchanged. No Kalshi market found. Sixth day without a trade; the Oct 31 leg expires tomorrow, and Coinbase said nothing about a US launch on its call.

Sign-off

Thirty-eight boards said no, the venue's parent bought a perps shop, and the oracle learned to work Saturdays. That's the tape. The bell isn't ringing.

Corrections and disclosures

No corrections to the Oct 29 issue surfaced. One note: the Oct 29 chart described the roster as "63 stocks from 62 companies"; CoinDesk and TokenPost count objectors against 62 companies, and today's 61% uses that base. One reconciliation: Coinbase's release and transcript say "over $1 billion" of tokenized stock volume on Base since launch; Investing.com's summary of the same call quotes the CFO at "$3 billion"; we use the company's figure.
